What your Loan Agreement covers
What is a Loan Agreement?
A Loan Agreement documents money lent and the promise to repay it: principal, interest rate, repayment schedule, what constitutes default, and what the lender can do about it. It can cover business loans, loans between individuals, or loans to family — anywhere real money changes hands.
It's more robust than a promissory note: where a note is the borrower's one-way promise, a loan agreement is a two-party contract with fuller terms.
Why it matters
Undocumented loans destroy relationships and evaporate in disputes — was it a loan or a gift? What was the rate? A signed agreement makes the debt real, sets expectations on both sides, and gives the lender enforceable remedies. Interest also has tax and usury-law implications worth getting right.
