The plain-English briefing

What is a Last Will and Testament?

A Last Will and Testament is the document in which you (the testator) direct who receives your property when you die, appoint an executor to carry those wishes out, and — if you have minor children — nominate the guardian who would raise them.

A will covers what you own at death and passes it through probate. It works alongside beneficiary designations and any trusts you have; the will catches everything those don't.

Why it matters

Without a will, state intestacy law decides who inherits — by formula, not by knowing your family — and a court chooses your children's guardian without your input. A will replaces those defaults with your actual wishes.

Your state's intestacy statute distributes your property by formula — typically to your spouse and closest relatives — regardless of what you would have wanted, and a court selects guardians for minor children.
Yes, any time you're competent: make a codicil for small changes or sign a new will that revokes the old one. Major life events — marriage, divorce, a new child, a big purchase — are the usual reasons to update.
Yes. Your answers shape the sections and language of the final document — including your parties, terms, and where relevant your state — so you're not left editing a generic template.
